Edgar Scott appeals an order denying his motion to withdraw his plea based on newly discovered evidence, filed pursuant to Florida Rule of Criminal Procedure 3.850. He also attacks his sentence based on the trial courts alleged failure to inquire into the factual basis for his plea and the trial courts imposition of restitution as a special condition of probation where the condition was not pronounced in open court and was not part of the plea agreement. We affirm the trial courts denial of appellants request to withdraw his plea and proceed to trial and decline to reach the other issues raised for the first time on appeal.
